Terms and conditions

Purpose
These Terms and Conditions (hereinafter, the "Terms") govern access to, subscription to and use of the technology solutions offered by Platomico as Software as a Service (SaaS), aimed exclusively at companies in the hospitality and restaurant sector.
Platomico's solutions include, among others: POS/Register software, KDS, Kiosk, Analytics, Web and integrations with delivery platforms, as well as any additional features that may be added in the future.
Scope and business-to-business nature
2.1Platomico's services are aimed exclusively at companies, professionals or legal entities, and their use by end consumers is expressly excluded.
2.2The user declares and warrants that they are acting within the scope of their professional or business activity and that they have sufficient legal capacity to contract on behalf of the entity they represent.
Registration and user account
3.1The Customer is responsible for safeguarding their access credentials and for all activity carried out from their account.
3.2Platomico shall not be liable for misuse of the account where such use is not directly attributable to the platform.
3.3To access the services, the Customer must create an account providing truthful, up-to-date and complete information.
Plans, subscriptions and add ons
4.1Platomico offers its services through monthly subscription plans per location, the prices, features and conditions of which are set out on the platform or on the official website.
4.2The Customer may subscribe to additional modules or add ons, subject to specific prices and conditions.
4.3Platomico reserves the right to modify, update or discontinue plans, features or add ons, giving the Customer reasonable prior notice.
Prices, payments and invoicing
5.1The prices stated do not include taxes, which will be passed on in accordance with applicable tax law.
5.2The Customer authorises Platomico to make the charges corresponding to subscriptions, transaction fees and additional services subscribed to.
5.3Total or partial non-payment of amounts due will entitle Platomico to suspend or cancel the service.
Permitted and prohibited use
6.1The Customer undertakes to use the services in accordance with the law, good faith, public order and these Terms.
6.2The following are expressly prohibited, among others:
- Using the service for unlawful purposes.
- Attempting to access unauthorised systems or data.
- Interfering with the normal operation of the platform.
Service availability
7.1Platomico will make reasonable efforts to ensure the availability of the service, without this implying any obligation of continuous or uninterrupted availability.
7.2The service is provided "as is" and "as available".
Third-party integrations
8.1Some features depend on third-party services or platforms (for example, delivery platforms).
8.2Platomico accepts no liability for failures, interruptions, changes or removals of such third-party services.
Intellectual property
9.1All intellectual and industrial property rights in the platform, the software and their content belong to Platomico or to its licensors.
9.2The Customer receives a limited, non-exclusive, non-transferable and revocable licence to use the service for the term of the subscription.
Data and confidentiality
10.1The Customer retains ownership of the data entered into the platform.
10.2Platomico will process the data in accordance with applicable data protection law and with its Privacy Policy.
Limitation of liability
11.1Platomico shall not be liable for indirect damage, loss of profit, loss of data, business interruption or third-party claims arising from use of the service.
11.2In any event, Platomico's maximum liability shall be limited to the amounts actually paid by the Customer in the twelve (12) months preceding the event giving rise to the claim.
Suspension and termination
12.1Platomico may suspend or terminate the contractual relationship in the event of breach of these Terms, non-payment or misuse of the service.
12.2The Customer may cancel their subscription in accordance with the conditions set out on the platform.
Amendments to the Terms
Platomico reserves the right to amend these Terms at any time. Amendments will be notified to the Customer and will be deemed accepted if they continue to use the service.
Governing law and jurisdiction
These Terms are governed by Spanish law. For any dispute, the parties expressly submit to the courts and tribunals of Madrid, unless the law provides otherwise.
